Welcome to Boats & Fish ("we", "us", or "our"), an online classifieds marketplace for boats, fishing equipment, marine services and related goods, operated from the United Arab Emirates.

By accessing or using https://www.boatsfish.com (the "Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please stop using the Platform immediately.

You must be at least 18 years old and legally capable of entering into binding contracts under UAE law to use the Platform. By registering, you confirm that you meet these requirements.

• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate, current and complete information during registration.
• You may register without completing phone verification, but certain Platform features remain restricted until your phone number is verified.
• To verify a phone number, you must separately agree to receive a one-time SMS verification code and enter that code correctly. This consent is for verification only and is not consent to marketing messages.
• Until phone verification is complete, you may not post listings, sell catch, or view seller contact details. We may apply additional safety-related restrictions to unverified accounts.
• You may not share your account or allow others to access it.
• We reserve the right to suspend or terminate accounts that violate these Terms.

When you post a listing on the Platform, you agree that:

• All information is accurate, truthful and not misleading.
• You are the legal owner of the item or are authorised to sell it.
• The item is legal to sell in the UAE and does not violate any applicable law.
• You will not post duplicate, spam or fraudulent listings.
• Listings are subject to review and may be rejected or removed at our discretion.
• Free listings are active for 30 days; Premium listings for 60 days.
• Listing fees are non-refundable once a listing has been published.

You must not use the Platform to:

• Post stolen, counterfeit or illegally obtained goods.
• Engage in fraud, misrepresentation or deceptive practices.
• Harass, threaten or abuse other users.
• Scrape, crawl or systematically extract data from the Platform.
• Circumvent any security or access-control measures.
• Post content that infringes third-party intellectual property rights.
• Violate any UAE federal or emirate-level law or regulation.

Boats & Fish is a classifieds platform only. We do not participate in, guarantee or take responsibility for any transaction between buyers and sellers. All negotiations, payments and handovers are solely between the parties involved.

We strongly recommend meeting in a safe, public location and verifying the item before completing any purchase. We are not liable for any loss, damage or dispute arising from a transaction conducted through the Platform.

Premium listing fees are processed securely via Stripe. By purchasing a Premium listing, you authorise the charge to your payment method. All fees are quoted in AED and are inclusive of applicable VAT where required.

Refunds are not available once a Premium listing has been activated and published. If a listing is rejected by our moderation team, a full refund will be issued within 5–10 business days.

Boats & Fish offers paid Professional Seller membership plans ("Membership") that grant subscribers enhanced listing capabilities and related features on the Platform. By purchasing a Membership, you acknowledge and expressly agree to the following terms, which form a binding part of this Agreement:

Active listing limits apply to simultaneously live listings. Expired, sold, or deactivated listings do not count toward the cap. Enterprise plan pricing is available upon request — contact [email protected]. Boats & Fish reserves the right to update plan pricing and limits; existing subscribers will be notified before any change takes effect.

1. Non-Refundable Fees. All Membership subscription fees are strictly non-refundable. Once a payment has been processed and a Membership has been activated, no refund, credit, set-off or reimbursement shall be due or payable under any circumstances, including but not limited to early cancellation, voluntary termination, change of mind, reduced usage, or dissatisfaction with the Platform's features or performance.
2. No Entitlement to Unused Period. A subscriber who cancels, terminates or does not renew a Membership prior to the expiry of the paid subscription period shall have no right, claim or entitlement to any refund, partial refund, pro-rated credit or compensation in respect of any unused portion of the Membership term, howsoever arising.
3. Suspension or Termination for Breach. If a Membership is suspended or terminated by Boats & Fish due to a breach of these Terms by the subscriber, no refund or credit shall be issued for any remaining subscription period. The subscriber shall remain liable for any outstanding fees due at the time of termination.
4. Renewal. Memberships do not renew automatically. It is the subscriber's sole responsibility to renew their Membership prior to expiry. Boats & Fish shall not be liable for any lapse in Membership benefits resulting from a failure to renew.
5. Price Changes. Boats & Fish reserves the right to amend Membership pricing at any time. Any price change will take effect at the next renewal cycle and will be communicated to subscribers in advance. Continued use of the Membership following a price change constitutes acceptance of the revised fees.
6. Compliance with UAE Consumer Protection Law. The foregoing non-refund policy is applied in accordance with Federal Decree-Law No. 5 of 2023 on Consumer Protection and its implementing regulations. Where a mandatory statutory right to a refund exists under applicable UAE law and cannot be contractually excluded, such right shall apply to the extent required by law and shall not be affected by this clause. For the avoidance of doubt, digital subscription services of this nature are not subject to a statutory cooling-off period under current UAE law.

By completing the payment process for a Membership, you confirm that you have read, understood and accepted the terms of this section in full.

All Platform content, design, code and branding are the property of Boats & Fish or its licensors. You may not reproduce, distribute or create derivative works without our prior written consent.

By posting content (photos, descriptions, etc.) on the Platform, you grant us a non-exclusive, royalty-free, worldwide licence to display and promote that content in connection with the Platform.

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free or free of viruses or other harmful components.

To the fullest extent permitted by UAE law, Boats & Fish shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data or goodwill.

These Terms are governed by the laws of the United Arab Emirates. Any dispute shall be subject to the exclusive jurisdiction of the courts of Abu Dhabi, UAE.

We may update these Terms from time to time. We will notify registered users by email and update the effective date above. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
